Lots of people wonder if they need to bother writing a will if they do not have children or are not married. Currently in the UK, there is a trend for couples to live together before they get married, and in lots of cases the rate of marriage is declining, with many couples choosing not to get married at all! This might be a good situation for the couple, however it might not be the most beneficial situation legally.
An issue which lots of couples do not necessarily realise, is that should one of the couple die without a will, under the rules of intestacy in England and Wales, all their property would go to their parents or siblings, bypassing any surviving unmarried partner!
If you live in a house together, for at least 10 years and it is one name, should that person die, the surviving partner would again have no claim to the house if unmarried.
